Identification and Placement of an English Learner (ELL) for Newly Arrived Children and Young People
The New York State Department of Education (NYSED) has decided to offer more flexibility in the identification and placement of English learners (ELLS) in areas affected by the increasing presence of refugee and other newly arrived students. This flexibility will provide the possibility to extend the deadline of the identification and placement process, i.e. the time required for the administration of the NYSITELL exam, from 10 school days to 30 school days.
Education Administrators (LEAS) who want to take advantage of this flexibility should submit an application form confirming the arrival of these students to their communities and providing information about these newly arrived students. This form can be accessed by supervisors and school leaders through the SED Job Portal.

It is committed to supporting Local Education Institutions (LEAS) to provide high-quality education and to provide this support for all students, including newly arrived children and young people.
This memorandum contains important information about students Learning English for LEAS (ELL) and includes a commitment to provide resources to students and their families to support the identification process under Section 154-2.3(a) of the Commissioner’s Regulation.
These commitments have been made with the aim of ensuring that our communities are successfully integrated within our education system, with a special emphasis on the education of newly arrived students.
